Terms and Conditions

1. About Tikiberry

Tikiberry is a peer-to-peer ticket resale platform operated by Poke Digital (Pty) Ltd, a company registered in South Africa. Tikiberry provides escrow services to facilitate safe digital transactions between buyers and sellers of event tickets. Tikiberry does not sell tickets directly and is not an event organiser or primary ticketing provider.

2. Acceptance of terms

By creating an account or using Tikiberry, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the platform.

3. Eligibility

You must be 18 years or older to use Tikiberry. By using the platform, you confirm that you meet this requirement.

4. The escrow process

When a buyer initiates a purchase, they specify where the ticket should be transferred to (typically the email registered on the same ticketing platform the seller listed from). The buyer's payment is then held in a conditional ledger by Tikiberry pending successful delivery. The seller does not receive funds until either (a) the buyer confirms receipt of a valid ticket, or (b) the buyer's confirmation window elapses without a dispute. Tikiberry acts as a neutral intermediary and does not take sides in disputes without investigation.

5. Transaction time limits

Each stage of a deal has a strict time window. If a window expires, the deal outcome is automated:

  • Seller acceptance: 24 hours from deal creation. If the seller does not accept, the deal is cancelled and the ticket returns to the market. No money moves.
  • Buyer payment: 15 minutes from seller acceptance. If not paid, the deal is cancelled. No money moves.
  • Seller transfer: 15 minutes from payment. If the seller does not mark the ticket as transferred, the deal is cancelled and the buyer receives a full refund.
  • Buyer confirmation: 30 minutes from the moment the seller marks the ticket as transferred. If the buyer does not confirm receipt or raise a dispute within this window, payment is automatically released to the seller.

Both the buyer and seller are entitled to one optional 10 minute extension per deal during the payment and transfer stages. The confirmation stage cannot be extended.

Buyers who did not receive a valid ticket but missed the 30 minute confirmation window may still report the issue to disputes@tikiberry.co.za within 24 hours of auto-release. Recovery is not guaranteed after auto-release and depends on funds availability, but Tikiberry will investigate every report.

6. Cancellation

Cancellation rules depend on which stage the deal is at:

  • Before seller acceptance: either party may cancel unilaterally.
  • After seller acceptance, before payment: the buyer may cancel unilaterally.
  • After payment, before ticket transfer: the buyer may request cancellation. The seller may approve the request (deal cancelled, buyer refunded) or complete the transfer (request is ignored). Cancellation requests do not automatically expire — this prevents buyers from unilaterally cancelling deals where the seller may already be mid-transfer.
  • After ticket transfer: cancellation is no longer available. The buyer must either confirm receipt or raise a dispute.

7. Seller obligations

Sellers must:

  • Only list tickets they legitimately own and have the right to sell.
  • Accurately describe the ticket including event, date, seat and any restrictions.
  • Correctly identify the ticketing platform their ticket lives on.
  • Accept or decline deals within 24 hours.
  • Transfer the ticket to the buyer's specified transfer destination within 15 minutes of escrow confirmation.
  • Not list duplicate tickets or sell the same ticket to multiple buyers.
  • Only list tickets that can be transferred digitally via a supported ticketing platform, or clearly select "Other" and arrange delivery directly with the buyer.
  • Provide proof of transfer (transfer confirmation email or screenshot) if a dispute is raised.

8. Buyer obligations

Buyers must:

  • Provide an accurate transfer destination (the email registered on the ticketing platform their ticket is on) at buy time.
  • Complete payment within 15 minutes of the seller accepting the deal.
  • Check the ticketing platform inbox promptly after the seller marks the ticket as transferred.
  • Confirm receipt within 30 minutes only after verifying the ticket is valid and as described.
  • Raise a dispute within the 30 minute confirmation window if the ticket has not arrived or is not as described.
  • Not confirm receipt before verifying the ticket.

9. Platform fee

Tikiberry charges a total 10% platform fee on every completed transaction, split evenly between buyer and seller: 5% is a protection fee added to the buyer's total, and 5% is deducted from the seller's take-home. Sellers see the exact amount they will receive at the time of listing. Buyers see one all-in price at checkout. There are no listing fees, no hidden fees, and no surprises. Fees are non-refundable once a transaction is marked complete.

10. Prohibited conduct

The following are strictly prohibited:

  • Listing counterfeit, invalid or already-used tickets.
  • Attempting to complete transactions outside of Tikiberry after initiating them on the platform.
  • Creating multiple accounts to abuse the platform.
  • Threatening or harassing other users.
  • Any fraudulent, deceptive or illegal activity.
  • Listing physical tickets that cannot be transferred digitally without disclosing this under "Other".
  • Raising bad-faith disputes to defraud sellers.
  • Confirming receipt of a ticket that was not actually received.

11. Disputes

Only the buyer may raise a dispute, and only while the deal is in the transfer confirmation stage. Raising a dispute freezes the deal and pauses all timers. Both parties are expected to submit evidence within 24 hours:

  • The seller must provide proof of transfer — typically a forwarded transfer confirmation email from the ticketing platform, or a screenshot showing the transfer.
  • The buyer may provide screenshots or other evidence showing non-receipt or that the ticket received is invalid or not as described.

Tikiberry will investigate and make a decision based on the evidence provided. Tikiberry's decision is final for disputes on the platform. Contact disputes@tikiberry.co.za for assistance.

12. Limitation of liability

Tikiberry is not liable for the actions of buyers or sellers. We facilitate transactions but do not guarantee the conduct of any party. Tikiberry's total liability to any user shall not exceed the value of the transaction in dispute.

13. Account termination

Tikiberry reserves the right to suspend or terminate any account that violates these terms, without notice or liability.

14. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.

15. Changes to terms

Tikiberry may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
