1. About Tikiberry

Tikiberry is a peer-to-peer ticket resale platform that provides escrow services to facilitate safe transactions between buyers and sellers of event tickets. Tikiberry does not sell tickets directly and is not an event organiser or primary ticketing provider.

2. Acceptance of terms

By creating an account or using Tikiberry, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the platform.

3. Eligibility

You must be 18 years or older to use Tikiberry. By using the platform, you confirm that you meet this requirement.

4. The escrow process

When a buyer initiates a purchase, their payment is held in escrow by Tikiberry. The seller does not receive funds until the buyer confirms receipt of a valid ticket. Tikiberry acts as a neutral intermediary and does not take sides in disputes without investigation.

5. Seller obligations

Sellers must:

  • Only list tickets they legitimately own and have the right to sell.
  • Accurately describe the ticket, including event, date, seat, and any restrictions.
  • Transfer the ticket to the buyer promptly after payment is confirmed in escrow.
  • Not list duplicate tickets or sell the same ticket to multiple buyers.

6. Buyer obligations

Buyers must:

  • Only confirm receipt once they have verified the ticket is valid and as described.
  • Not confirm receipt as a favour to the seller before verifying the ticket.
  • Raise disputes within 48 hours of receiving a ticket if there is an issue.

7. Platform fee

Tikiberry charges a 10% platform fee on every completed transaction, deducted from the seller's payout. There are no fees for listing tickets or for buyers. The fee is non-refundable once a transaction is marked as complete.

8. Prohibited conduct

The following are strictly prohibited:

  • Listing counterfeit, invalid, or already-used tickets.
  • Attempting to complete transactions outside of Tikiberry after initiating them on the platform.
  • Creating multiple accounts to abuse the platform.
  • Threatening or harassing other users.
  • Any fraudulent, deceptive, or illegal activity.

9. Disputes

If a dispute arises, either party may raise it through the Deal Room. Tikiberry will investigate and make a decision based on evidence provided by both parties. Tikiberry's decision is final for disputes on the platform.

10. Limitation of liability

Tikiberry is not liable for the actions of buyers or sellers. We facilitate transactions but do not guarantee the conduct of any party. Tikiberry's total liability to any user shall not exceed the value of the transaction in dispute.

11. Account termination

Tikiberry reserves the right to suspend or terminate any account that violates these terms, without notice or liability.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of South African courts.

13. Changes to terms

Tikiberry may update these terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated terms.
